Wills and Probate

Coping with the loss of a loved one can become even more difficult to manage when disputes arise with others regarding the administration of the estate and/or inheritance. 

Such disputes may include:-

  • Who should apply for the Grant of Probate.

  • A beneficiary who believes that an executor is not dealing properly with the estate.

  • A relative who has not been included in a Will and believes they should have been.

If such disputes do arise they are usually very difficult for those directly involved to resolve due to the emotion and grief of the situation.  The options for resolving these disputes in law are very expensive and time consuming.

Mediation offers those who find themselves in such a situation, the option of resolving the dispute not only without the significant legal costs and time which the legal remedies would involve, but also with a far greater likelihood that the relationship between the family members concerned will not be permanently damaged and will, at least to some extent, be restored. 

With legal costs amounting to tens of thousands of pounds for a contested probate case increasingly families are also looking to resolve such a dispute through mediation for financial reasons.
